Sending the question of arbitrability to an arbitrator when the demand for arbitration is “wholly groundless” seems “counterintuitive”, commented US Supreme Court Justice Sonia Sotomayor during oral arguments on who should decide the arbitrability of an antitrust dispute involving dental products distributors.
