Unclean hands arguments to remain in Yukos appeal
In the first judgment in an appeal against the set aside of Energy Charter Treaty awards against Russia worth U$50 billion, the Hague Court of Appeal rejected requests by the former majority shareholders in Yukos to strike out Russia’s submissions regarding their alleged “unclean hands” and other matters, while ruling that allegations of procedural fraud in the arbitration are inadmissible.
