Belgium’s supreme court has affirmed a controversial ruling that ICC awards can be drafted by tribunal secretaries if their work is reviewed by the arbitrators.

Belgium’s Court of Cassation has been asked to review a court ruling that found the drafting of an ICC award by a secretary was not an improper delegation of the tribunal’s decision-making powers.

UPDATED WITH TRIBUNAL: A Belgian court has refused to set aside an ICC award in favour of the European Commission on the basis of allegations that it was partly drafted by a tribunal secretary, ruling there was nothing wrong with the practice so long as their work is reviewed by an arbitrator.

Since the launch of its tribunal secretary service four years ago, Hong Kong International Arbitration Centre legal counsel have been appointed as tribunal secretary on 20 occasions in a total of 19 arbitrations, the centre has reported.

In a move reminiscent of Russia’s challenge to the Yukos awards, Gazprom has alleged that a tribunal secretary drafted a “considerable portion” of a US$4.63 billion SCC award issued in favour of Ukrainian state entity Naftogaz earlier this year in a dispute over transit of gas.
