When that firm began to feel the effects of the financial crisis, they decided the time was ripe to set up on their own. Chaffetz Lindsey was born in May 2009. By then Peter Chaffetz had been global head of litigation and David Lindsey co-head of the Americas international arbitration group.
Today, Lindsey and younger partner James Hosking carry the bulk of the international arbitration matters while Chaffetz and others focus more on insurance, reinsurance and securities disputes, but handle arbitration in those areas. The team also draws on two experienced senior associates (Yasmine Lahlou and Andreas Frischknecht) and has added five new associates in the past year.
Lindsey in particular has been active in promoting New York as a place for international arbitration: he is a founding member of the New York Arbitration Club, and has now contributed a chapter, with Lahlou, in the recent International Commercial Arbitration in New York (Kluwer, 2010). Hosking meanwhile is coaching the Harvard Law School team for the 2011 Vis Moot.
Lahlou is a former member of Castaldi Mourre, who co-chairs the Middle East committee of the ABA’s section of international law.
Recent events
Chaffetz Lindsey is acting for a European pharmaceutical company in an arbitration with a major multinational over a licensing agreement being heard at the Permanent Court of Arbitration in The Hague. The team has also steered a US$100 million dispute about indemnity claims arising from a M&A deal to a settlement, on behalf of a Latin American energy business. The dispute involved assets in multiple Latin American jurisdictions. Lindsey and Hosking are also continuing to represent AES in ICSID arbitration against Argentina (those proceedings are suspended while Argentina implement certain tariff increases and other reforms negotiated with AES). The firm has live cases taking place in Singapore and Tokyo.

The disputes arise under the rules of the ICC, AAA/ICDR, SIAC, SCC, LCIA, ICSID and UNCITRAL.
Chaffetz Lindsey also has an active US state and federal court litigation practice. The firm’s expertise encompasses all aspects of general commercial litigation, with particular experience in claims involving finance/securities, re/insurance, cross-border disputes and sovereign immunity issues.
