A US appeals court has upheld a US$70 million ICDR award rendered by a nine-man tribunal against affiliates of a Chinese state-owned aerospace company, rejecting arguments it was “fundamentally unfair” for one side in the dispute to appoint over twice as many arbitrators as the other.
