Ecuadorean court to rule on constitutionality of ISDS clauses

As the negotiation of its new bilateral investment treaties continues, Ecuador’s congress has approved a motion to ask the constitutional court whether investor-state arbitration clauses in BITs are prohibited under the Ecuadorean constitution.
