Dual national fails to revive Mauritius claim

A Belgian court has ruled that an UNCITRAL tribunal was right to decline jurisdiction over a French-Mauritian businessman’s US$1 billion treaty claim against Mauritius based on his dual nationality.

Colombia defeats telecoms and banking claims

Colombia has prevailed in two investment treaty disputes – a billion-dollar ICSID claim by Mexico's América Móvil over the alleged expropriation of a telecoms concession and a US$323 million UNCITRAL claim brought by three dual nationals over their former ownership of a bank.

A tribunal has declined jurisdiction over a US$370 million investment treaty claim against Venezuela after finding that the state had not consented to UNCITRAL arbitration – also saying it would have rejected the case in any event because of the investors’ dual nationality.
