Vivek Kapoor is a member of Stephenson Harwood’s international arbitration practice group. He has extensive experience of investor-state disputes and large scale, complex and highvalue commercial disputes.
Vivek acts as counsel and advocate in international arbitrations conducted under the LCIA, ICC, SIAC, and UNCITRAL rules and ad-hoc arrangements, and arising from diverse industry sectors, particularly energy, mining and natural resources, infrastructure, construction and engineering, defence, manufacturing, telecom and technology sectors.
He advises and represents both private and state-owned entities from jurisdictions in Asia, Europe, CIS, Africa, and Middle East in disputes governed by a variety of common and civil law regimes, and public international law.
Vivek also advises foreign investors, particularly those investing in the emerging economies of Asia and Africa, on issues pertaining to investment protection notably under bilateral investment treaties and investor-state contracts, and the interaction between international law and domestic law in relation to international projects.
Vivek has undertaken significant advocacy before international tribunals. Vivek is called to the bar of England & Wales by the Honourable Society of the Inner Temple. He also has full rights of audience in the Indian courts, and has successfully represented private parties, both Indian and Fortune 500 multinational corporations, before the Supreme Court of India and the High Courts of various States in India.
He has also advised on a full spectrum of post-award remedies, enforcement, jurisdictional challenges and conflict of laws issues.
He is empanelled as an arbitrator with the International Centre for Alternative Dispute Resolution (working under the aegis of Ministry of Law & Justice, Government of India). He also serves on the editorial advisory board of LexisNexis Arbitration and the management committee of the Asia- Pacific Forum for International Arbitration.
Vivek is recognised in Legal 500 UK (2019) as a “Next Generation Lawyer” for International Arbitration and ranked in Legal 500 for Public International Law and International Arbitration (2018, 2019).
