Spain asks for ECJ to rule on ECT

As part of its efforts to set aside a €53 million SCC award, Spain has asked a Swedish court to seek a preliminary ruling from the European Court of Justice on the compatibility of the Energy Charter Treaty with EU law in the wake of the landmark Achmea decision on intra-EU investment arbitration.
