Our well intentioned attempts at harmonisation in international arbitration are having the perverse effect of making it less flexible and attractive to users, says Paul Cohen, an arbitrator practising from London and San Francisco. As meaningful competition to arbitration grows, we need to be more creative or we'll be left behind.
