Appeals court affirms extraterritorial reach of US discovery
A US appeals court has refused to allow a group of Mexican investors to obtain discovery from Spanish bank Santander in support of an investment treaty claim against Spain – while finding courts are not “categorically barred” from ordering disclosure of documents held abroad.
