Another set-aside in Spain makes heads spin

Highlighting a growing trend of “judicial activism” in Spain, practitioners have expressed concern at a court’s decision to set aside an award in a dispute over a wind farm on the basis that a tribunal majority irrationally ignored evidence that was highlighted by a dissenting arbitrator.
